Discussion of bankruptcy procedure development was held at the meeting of the Federal Tax Service of Russia with Kazakhstan colleagues

The Federal Tax Service of Russia shared its experience in improving the institute of bankruptcy with the Public Revenue Committee of the Ministry of Finance of the Republic of Kazakhstan. The meeting covered the issues of individual bankruptcy, digitalization of procedures, and interaction with registration authorities, as well as the organizational structure and administrators of such procedures.

Konstantin Chekmyshev, Deputy Head of the Federal Tax Service of Russia, mentioned that since 2015, the Federal Tax Service of Russia has been reforming the institute of bankruptcy, changing the process approach to project management, and using digital technologies to optimize and improve the efficiency of its procedures.

To this end, the FTS of Russia has developed an integrated debt management and administration system (IDMAS), accumulating information about the debtor into a digital portrait using available sources, including fiscal data, monetary obligations, personal connections, etc.

The system collects data on assets, liabilities, all debtor's relationships, transactions, and affiliated persons. This greatly facilitates the work of a tax inspector, who could spend months collecting and analyzing such information. By means of the information collected by IDMAS, the inspector can form a procedural statement much faster and bring controlling persons to subsidiary liability for obligations.

The same principle of portraying the debtor's connections is also used in individual bankruptcy procedures. At the same time, the institute of out-of-court bankruptcy for citizens has been operating in the Russian Federation since 2020. If the amount of debt does not exceed 500 thousand rubles and the citizen has no income or property to recover, which is confirmed by an act of the Federal Bailiff Service, the debtor can file an application in any Multifunctional Public Services Center (MPSC) to declare himself bankrupt out of court.

In addition, the Kazakhstan delegation visited the Directorate of the Federal Tax Service of Russia in the Republic of Tatarstan. Its Head, Marat Safiullin, during a visit to the Kazan MPSC, demonstrated the out-of-court bankruptcy procedure from filing an application up to inclusion in the Unified Federal Register of Bankruptcy Information and shared information about the interaction of tax authorities with the MPSC.
